In the 1930s, the Home Owners’ Loan Corporation (HOLC) graded the mortgage security of urban US neighborhoods. In doing so, the HOLC engaged in the practice, imbued with racism and xenophobia, of “redlining” neighborhoods deemed “hazardous” for lenders. Redlining has caused persistent social, political and economic problems for communities of color. Linkages between redlining and contemporary food access remain unexamined, even though food access is essential to well-being. To investigate this, we used a census tract-level measure of low-income and low (...) grocery store food access from the US Department of Agriculture Food Access Research Atlas, redlining data from Mapping Inequality Project, and demographic data from the American Community Survey. We employed generalized estimating equations with robust covariance estimates to analyze data pertaining to 10,459 census tracts in 202 US cities. Tracts that the HOLC graded as “C” (“decline in desirability”) and “D” (“hazardous”) had reduced contemporary food access compared to those graded “A” (“best”). Increases in contemporary census tract proportions of Black, Hispanic, or other racial/ethnic minority residents, as well as disabled residents, were associated with reduced food access. Increases in contemporary proportions of residents age 75 years and older or those without a car were associated with better food access. Tracts that underwent housing redevelopment since being graded had better food access, while those undergoing gentrification had reduced food access. Results suggest that issues of redlining, housing discrimination, racism, ableism, displacement, and food inaccessibility are deeply intertwined. (shrink)

There is a tension between the pedagogical aim of comparative and cross-cultural inclusion and teaching an introductory-level deductive logic course. On the one hand, those who are interested in including non-“Western” sources are doing so in order to expand the philosophical content under consideration in their courses. On the other, it seems that the student learning objectives for deductive logic classes aimed at novices are narrow and specific for the purpose of developing a particular skill. This paper highlights the challenge (...) of teaching logic cross-culturally by arguing that it is inadvisable to do so. Using Jain logic as a case study, it illustrates that even though there is depth available in the content, the contextual support needed to compare logics without being reductive would interfere with the amount of time needed to develop deductive logic skills in students in the first place. Short’s assertion that Peirce lacked a cohesive philosophical system is critically examined, and the interconnectedness of Peirce’s 1884–1893 “cosmology” with other aspects of his work is explored, countering Short’s claims of its limited systematic relevance. Additionally, Short’s claim that Peirce “expanded empiricism empirically” is scrutinized, and his interpretation of Peirce’s account of perception is criticized. By contrasting Short’s anti-system reading, I highlight the importance of studying Peirce’s philosophy holistically.

Lane could not have given his monograph a more concise and descriptive title. He never strays from (...) the topics of realism and idealism, and it is remarkably complete. It includes extensive discussion on Peirce's basic realism (Lane's term) as well as his extreme scholastic realism (Peirce's term), his basic idealism (Lane's term), and his objective idealism (Peirce's term). It might not be the best resource for those interested in the historical influences on Peirce's forms of realism and idealism. For instance, if one is interested mainly in Peirce's extreme scholastic realism and its roots in scholastic philosophy, Mayorga (2007)1 might still be a more useful resource. Also, Lane leaves much to be said about the epistemological underpinnings of Peirce's forms of realism and idealism. Peirce's theory of perception and his critical common-sensism do not get much attention. Also, there is much in Peirce's later semeiotic writings that could have been brought to bear on the issues.However, I do not see any of these omissions as failures of Lane's work. As I read it, the book's central aims are to determine the following: (1) what metaphysical views did Peirce hold, (2) when did he hold them, (3) are they consistent with one another, and (4) what is the textual evidence that he held them as such. With respect to these aims, Peirce on Realism and Idealism exhibits the gold standard of Peirce scholarship: it is remarkably sensitive to dates, different writings, and contexts of writings, and the reader gets a strong impression that Lane has not left any stone unturned—that he had at least skimmed every word in every lecture, published writing, letter, and unpublished manuscript that Peirce produced.Although the book contains some interpretations about which I have some reservations, which I describe further on, I agree with most of its central claims. This includes the claim that, despite various developments, Peirce had always subscribed to "basic realism": the thesis that there are things independent of what anyone thinks about them. A whole chapter is dedicated to showing that Peirce's 1868–1869 "anti-Cartesian" papers are consistent with basic realism, and I found that chapter very helpful. Another thesis that Lane defends, and that I strongly agree with, is that Peirce held a representationalist view of truth. After works by Christopher Hookway, Cheryl Misak, and others that attempt to de-emphasize or obscure Peirce's representationalism, perhaps to make him more appealing to contemporary analytic "neopragmatists," it is absolutely refreshing to read a book that embraces Peirce's representationalism without apology.However, in the remainder of this review, I will focus on parts that I found troubling. Some of this trouble is probably due more to Peirce himself than to Lane's interpretation of Peirce. But some of it directly concerns Lane's interpretation. In particular, the parts of chapter 6 concerning Peirce's modal realism, while stimulating and enlightening, are also problematic. Further, I do not think that Lane's account of Peirce's idealism appropriately recognizes its similarity to Hegelian or Absolute idealism.To begin with Peirce's modal realism, Lane's discussion of it sets out by addressing the fact that, as Peirce recognizes, the conditionals comprising "pragmatic clarifications," or what result from applying the "pragmatic maxim" to a concept, must be in the hypothetical or subjunctive mood. (...) His first book on Peirce, Peirce and the Conduct of Life (2016), focuses on ethics and religion, while the focus of his second, Charles S. Peirce's Phenomenology (2018), is evident from the title. Now, Peirce on Inference: Validity, Strength, and the Community of Inquirers (2023) is a detailed analysis of key parts of Peirce's logic—mainly the part of logic he called Critic, "which classifies arguments and determines the validity and degree of force of each kind" (EP 2:260). Perhaps what is remarkable is that none of Atkins's three books on Peirce are directly about pragmatism or pragmaticism. Of course, connections abound, but had Atkins chosen instead to write books on Peirce on meaning, on truth, on inquiry, or even on reality, pragmatism would have occupied a more central place in them. He has articles relating to these topics, and perhaps his fourth book on Peirce will put pragmatism in center, but I find it invigorating that someone has done as much justice to the richness of Peirce's philosophical thought outside pragmatism or pragmaticism as Atkins has done.The layout of Peirce on Inference is very straightforward. First, how should we understand the nature of inference and arguments in general, according to Peirce; second, how does Peirce go about classifying inferences into main types; and third, how does Peirce understand the nature and the validity of each main type of inference. I will, then, comment on the classification issue, particularly as it concerns abduction. For the sake of space, I will say very little about Atkins's accounts of Peircean deduction and induction. I found the parts on deduction very informative, though that could be attributed to my own lack of focus on deduction in Peirce. The parts on induction, easily the basic type of inference to which Atkins gives the most attention, are philosophically rich. He includes a chapter on objections and replies to Peirce's account of induction and its validity, ranging from circularity objections to underdetermination objections, to Goodman's famous "grue" problem, and here Atkins is careful to distinguish between Peirce's replies and Peircean replies. As there is too much to comment on here, I will put aside induction in the remainder of my review, remarking only that Atkin's book is a must read for anyone wanting to engage Peirce on induction. Instead, I focus on the psychologism issue and on what Atkins says about Peirce on abduction.1. PsychologismAtkins distinguishes between inference and argument in Peirce, taking inference to be "a category of mental action" while taking argument to be "a category of semiotic relations" (8). Thus, according to (Atkins's) Peirce, logic is "a science of thought insofar as it studies the process of inferring" (ibid.). Some might regard this already to be too psychological a reading of Peirce's logic. But it is well supported by Peirce's texts, and Atkins argues that it does not undermine Peirce's "unpsychological view of logic" (9). The reason it doesn't is simple: while logic is a science of thought so far as it studies inference as a mental process, the "broader target is the sorts of inferences that could be made and how far they are good" (9). Abstract:Peirce held a convergence theory of moral truth, as James Liszka persuasively argues in Charles Peirce on Ethics, Esthetics, and the Normative Sciences (2021). Here I emphasize: (1) that Peirce's convergence theory follows from the application of the maxim of pragmatism to the concept of moral goodness or rightness; (2) that in connection with Peirce's account of the ethical summum bonum, morally right action can be understood as action that conforms or contributes to the growth of concrete reasonableness; and (3) (...) that, for Peirce, the growth of concrete reasonableness seems to be a movement or development toward "God". While I broadly agree with Liszka's approach, I highlight some disagreements. As do many readers of Peirce, Liszka seems to regard the convergence of beliefs and habits as necessarily a convergance among the "indefinite community" of distinct persons or inquirers; however, there is sufficient evidence that Peirce came to think that, if any given person were to live long enough, they would come to the same conclusions or rest in the same habits on their own. With respect to morality, even the most evil person would eventually come around to the moral truth. (shrink)

This book is a cross-cultural intervention in analytic epistemology that offers an alternative to the narrow conception of knowledge as justified true belief. It develops a framework for a comparative epistemology, illustrating the hermeneutic circularity of knowing to accurately and responsibly approach both Western and non-Western philosophy.

Idealist and Strong Empiricist approaches to Peirce’s thought are irreconcilable so far as an Idealist interpretation commits Peirce to some form of a priori knowledge, particularly a priori knowledge of the conditions of empirical knowledge. However, while I favor the strong empiricist approach, I agree that there is something like a “condition for the possibility of empirical knowledge” in Peirce, and that this lies with his famous conjecture that, with enough time and experience, there would be a “final result” of (...) all inquiry – “the Final Opinion.” Though some argue that this is mainly a regulative assumption or intellectual hope in Peirce, I contend that he is committed to it as an empirical hypothesis which we should provisionally accept. As an empirical hypothesis, it is not a transcendental constraint on knowledge, though it can be considered a transcendental feature (following Sacks’ (1997) distinction). That is, the thesis explains how knowledge is possible, but the epistemic status of the thesis itself is dependent on the course of experience. Here I explain how it is an empirical thesis and I explain the empirical considerations Peirce thinks support it. Though Peirce should not be considered a transcendental idealist in any robust sense, I give reasons for why he could still be considered a sort of absolute idealist. (shrink)

Steve Coutinho's Zhuangzi and Early Chinese Philosophy: Vagueness, Transformation and Paradox, is a comparative philosophy project masterfully carried out on two levels, the methodological and the interpretive. Coutinho provides a translation of the Zhuangzi that is both contextually rooted and philosophically rich. Whether or not one agrees with Coutinho's interpretation, there is much to be gleaned from his book. The first few chapters create a meta-philosophical structure that the rest of the book puts to use. BackgroundCORE (Clarity and Openness in Reporting: E3-based) Reference (released May 2016 by the European Medical Writers Association [EMWA] and the American Medical Writers Association [AMWA]) is a complete and authoritative open-access user’s guide to support the authoring of clinical study reports (CSRs) for current industry-standard-design interventional studies. CORE Reference is a content guidance resource and is not a CSR Template.TransCelerate Biopharma Inc., an alliance of biopharmaceutical companies, released a CSR Template in November 2018 and recognised CORE Reference as one of (...) two principal sources used in its development.MethodsThe regulatory medical writing and statistical professionals who developed CORE Reference conducted a critical review of the TransCelerate CSR Template. We summarise our major findings and recommendations in this communication. We also re-examined and edited the Version 1 CORE Reference Terminology Table that we first published in 2016, and we present this as Version 2 in this communication.ResultsOur major critical review findings indicate that opportunities remain to refine the CSR Template structure and instructional text, enhance content clarity, add web links to referenced guidance documents, improve transparency to support the broad readership of CSRs, and develop supporting resources.The CORE Reference ‘Terminology Table’ Version 2 includes estimand as a defined term and an adaptation of the original ‘worked study example’ to incorporate the recently evolved concept of ‘estimands’.ConclusionsAs TransCelerate’s CSR Template represents an important milestone in authoring CSRs, we offer CSR authors advice and recommendations on its use, similarities, and differences with CORE Reference and advise them to consider shared interpretations between the two.RegistrationCORE Reference is registered with the EQUATOR Network. In this article the author, in a context in which principles and the principle of proportionality are at the heart not only of jurisprudence but also of constitutional and human rights interpretation, claims that when there were those ready to raise the hand to declare a unanimous winner, some critics and skeptics appeared. In addition, to the traditional objections, they worry that proportionality invites to doing unnecessary balancing between existing rights, inventing new rights out of nothing at all (in detriment (...) of those already well-established ones), and even worse in doing so balancing some rights away. In order to answer to such objections and to reject them, as well as to reinforce the importance of this development, the author: first, revisits the constitution of principles and of the principle of proportionality, which per definitio contradicts each one of this objections; and, then, restates the constitution of the principle of proportionality as a principle of principles not only in constitutional and human rights interpretation but also in legislation, including constitutional reformation, and adjudication.Resumen:En este artículo el autor, en un contexto en el cual los principios y el principio de proporcionalidad están en el corazón no solamente de la filosofía y teoría del derecho sino además de la interpretación en materia constitucional y de derechos humanos, argumenta que cuando había quienes estaban listos para levantar la mano para declarar a un ganador unánime, algunos críticos y escépticos aparecieron. As genomic science has evolved, so have policy and practice debates about how to describe and evaluate the ways in which genomic information is treated for individuals, institutions, and society. The term genetic exceptionalism, describing the concept that genetic information is special or unique, and specifically different from other kinds of medical information, has been utilized widely, but often counterproductively in these debates. We offer genomic contextualism as a new term to frame the characteristics of genomic science in the debates. (...) Using stasis theory to draw out the important connection between definitional issues and resulting policies, we argue that the framework of genomic contextualism is better suited to evaluating genomics and its policy-relevant features to arrive at more productive discussion and resolve policy debates. Revisiting the influence of Hans Kelsen in Mexico requires a revision not only of his visits to Mexico and of the Mexicans to him, but also the different accounts of his thought that exist in Mexico. Hence, we commence by remembering his visits to Mexico —from the cancelled to the consummated, including a endless lists of invitations to visit the country; we continue with the visits of the Mexicans to Kelsen; and we conclude with a visit to Kelsen in Mexico, (...) where we proceed to review the bibliography published both of and on him in Mexico or of Mexican authors. For that purpose, I will do a brief recount of his published works and of the existing debates regarding the extent of influence of his thought —or the fidelity of both kelsenians and antikelsenians. Praising wishful thinking is a serious risk that I am willing to run not only in this article commenting of Natalie Stoljar’s work but also elsewhere in my own scholarship. Although I will analyze her claims and will agree mostly with them, I will criticize her for stopping one step short adopting the desirability or weaker claim, when in it is not merely possible but necessary to go one step beyond arguing for the necessity or stronger claim. Accordingly, I intend (...) to present further grounds for endorsing “conceptual (legal) analysis pluralism” by distinguishing the three different inquiry or projects that are and must be integrated and stating the normative priority of one of them, i.e. the prescriptive, interpretive, and moral.Resumen:Alabar el “pensamiento ilusorio y bien intencionado” es un riesgo que estoy dispuesto a correr no solamente en este artículo para comentar el trabajo de Natalie Stoljar sino además en el resto de mi producción académica. Aun cuando voy a analizar su argumento y voy a estar de acuerdo en la mayor parte con ella, también la voy a criticar por detenerse un paso antes al adoptar la tesis de la deseabilidad o tesis débil, cuando no es meramente posible sino necesario ir un paso más allá al adoptar la tesis de la necesidad o tesis fuerte. In this Article, I assess James E. Fleming’s Fidelity to Our Imperfect Constitution. For Moral Readings and Against Originalisms. For that purpose: in Part II, I reexamine Ronald Dworkin’s “moral reading”; in Part III, I reevaluate Fleming’s argument both “for moral readings and against originalisms”, which can be characterized as “fidelity to our imperfect constitution”; in part IV, I explicit three very helpful dichotomies to distinguish between moral readings, originalisms and legal pragmatism aka living constitutionalism: (1) fidelity and anti-fidelity; (2) (...) interpretation and non-interpretation aka (re)construction, (re)invention and (judicial) legislation; and (3) perfectionimperfection. Additionally, I reintroduce Lon L. Fuller’s distinction between “intelligent and unintelligent fidelity”, to point out the kind of fidelity that moral readers and everyone else must adopt: an intelligent fidelity; and, finally, I present my general conclusion. For that purpose, first, he recalls some of the main features that Dworkin had advanced in previous but intrinsically related works, about political morality, equality and democracy; second, he reassess the arguments for a partnership conception of democracy; third, he reconsiders the resistance produced by Jeremy Waldron in his “A Majority in the Lifeboat” (...) and the response provided by Dworkin, but since it may appear insufficient, he intends to present an alternative —or complemen- tary— riposte in order to meet Waldron’s challenge; and, finally, he insists in the importance of taking Ronald Dworkin seriously.Resumen:En este artículo el autor se enfoca principalmente en la última parte de Justice for Hedgehogs (Justicia para erizos), de Ronald Dworkin y en su argumento a favor de la concepción asociativa o societaria de democracia. In this article the author claims that Waluchow’s “living tree constitutionalism” constitutes a “copernican revolution in our thinking”, because it provides not a mere common law theory of judicial review but a general theory of judicial review and of constitutional democracy. Although agrees that something like the common law methodology is at play here, disagrees on characterizing it as bottom-up. Accordingly, intends to praise the main aspiration of A Common Law Theory of Judicial Review: The Living Tree, i.e. to provide (...) a better understanding of charters and judicial re- view in a constitutional democracy by “the living tree” metaphor; to appraise an unwarranted claim, i.e. to reduce it to the common law bottom-up methodology; and, to raise the alternative with a friendly amendment, i.e. to identify the community’s constitutional political morality via, a method that is both bottom-up and top-down, which is already explicit —or at least implicit— in his account.Resumen:En este artículo el autor sostiene que el “constitucionalismo del árbol viviente” de Waluchow constituye una “revolución copernicana en nuestro pensamiento”, dado que proporciona no sólo una teoría del judicial review, sino una teoría general del judicial review y de la democracia. No obstante que el autor coincide en que en esta teoría de Waluchow existe un lugar para una metodología del common law, discrepa en caracterizarla como una que va de “abajo hacia arriba”. Por lo tanto, el objetivo del artículo es resaltar la importancia del argumento principal del libro A Common Law Theory of Judicial Review: The Living Tree por medio del cual se intenta proporcionar un mejor entendimiento de las garantías individuales y del judicial review, pero advertir una consecuencia innecesaria, es decir, reducir la explicación a una metodología del common law de “abajo hacia arriba”. A su vez el autor pretende proporcionar una corrección amigable: identificar la moralidad política constitucional de la comunidad a través de un método que es tanto de “abajo hacia arriba” como de “arriba hacia abajo”, metodología que se encuentra implícita en el libro de Waluchow. This article investigates the moderating effects of organizational social consciousness on the natural environmental competency and innovativeness relationship. Organizational social consciousness reflects the organization’s awareness of its place and contribution to the larger system in which it exists and is developed through an organization’s social responsibility, ethics, culture, corporate values, and the view of its stakeholders. Through our study of key strategic decision makers from organizations located in the USA, we operationalize organizational social consciousness and demonstrate the efficacy of this (...) construct in relation to the organizational-level constructs of environmental management competency and innovativeness. In this article the author, in the context of the fiftieth anniversary of H. L. A. Hart’s The Concept of Law, reconsiders the moderate indeterminacy of law thesis, which derives from the open texture of language. For that purpose, he intends: first, to analyze Hart’s moderate indeterminacy thesis, i.e. determinacy in “easy cases” and indeterminacy in “hard cases”, which resembles Aristotle’s “doctrine of the mean”; second, to criticize his moderate indeterminacy thesis as failing to embody the virtues of a center (...) in between the vices of the extremes, by insisting that the exercise of discretion required constitutes an “interstitial” legislation; and, third, to reorganize an argument for a truly “mean” position, which requires a form of weak interpretative discretion, instead of a strong legislative discretion.Resumen:En este artículo el autor, en el contexto del cincuenta aniversario de El concepto del derecho de H. L. A. Hart, reconsidera la tesis de la indeterminación moderada del derecho, la cual deriva de la textura abierta del lenguaje. Para tal propósito, pretende: primero, analizar la tesis de la indeterminación moderada del derecho, i.e. determinación en los “casos fá- ciles” e indeterminación en los “casos difíciles”, la cual recuerda la “doctrina del término medio” de Aristóteles; segundo, criticar la tesis de la indeterminación moderada del derecho por fracasar en dar lugar al término medio virtuoso entre extremos viciosos, al insistir que el ejercicio de la discreción requerida constituye una legislación “intersticial”; y, tercero, reorganizar un argumento para una verdadera posición intermedia, la cual requiere de una forma de discreción interpretativa débil, en lugar de una forma de discreción legislativa fuerte. In this article the author claims that the absence of a an adequate explanation of legislation within legal theory, jointly with the lack of legislators and of legislatures in jurisprudential discourse, creates —and reinforces— the presumption that adjudication, judges, and courts are central to the understanding of law. Hence, he intends not only to rebalance the relationship between legislation and adjudication, by requiring that both meet the same standards of coherence and consistency, predictability and acceptability, rationality and objectivity, but also (...) to explore the forms and limits of legislation, by challenging from the point of view of constitutionalism the idea that legislation as a sovereign activity is completely limit-free.Resumen:En este artículo el autor argumenta que la ausencia de una explicación adecuada de la legislación al interior de la teoría del derecho, junto con la falta de legisladores y de las legislaturas en el discurso filosófico-jurídico, crea —y fortalece— la presunción de que la adjudicación, los jueces y los tribunales son centrales al entendimiento del derecho. Por tanto, pretende no sólo equilibrar la relación entre legislación y adjudicación, al requerir que ambos cumplan los mismos estándares de coherencia y consistencia, predicción y aceptabilidad, racionalidad y objetividad, sino también explorar las formas y los límites de la legislación, al cuestionar desde el punto de vista del constitucionalismo la idea de que la legislación como una actividad soberana está completamente libre de límites. This book's aims are to determine the importance of legal philosophy in legal education and in addition to develop alternative methods for teaching law in general and the philosophy of law in particular. In this context, the individual essays in this volume discuss the alternatives and tendencies in the quest for an adequate model of teaching and learning jurisprudence. Common to all of them is a commitment to the necessary integration of theoretical and practical knowledge, of traditional case and lecture (...) methods with non-traditional models such as cinema, drama, and literature, and of the dominant legal perspective with alternative approaches utilizing information technologies such as computers and the internet. Effective teaching and learning must favor critical and strategic thinking, dialectical and dialogical inquiry or research, problem-solving, role-playing, and skill-developing over mere rote memorization of existing rules and standard answers. This article provides practical guidance for researchers who wish to enroll and collect data from pediatric research participants through online and mobile platforms, with a focus on the involvement of both children and their parents in the decision to participate.

Extending new verbs is important in becoming a productive speaker of a language. Prior results show children have difficulty extending verbs when they have seen events with varied agents. This study further examines the impact of variability on verb learning and asks whether variability interacts with event complexity or differs by language. Children in the United States, China, Korea, and Singapore learned verbs linked to simple and complex events. Sets of events included one or three agents, and children were asked (...) to extend the verb at test. Children learning verbs linked to simple movements performed similarly across conditions. However, children learning verbs linked to events with multiple objects were less successful if those events were enacted by multiple agents. A follow-up study rules out an influence of event order. Overall, similar patterns of results emerged across languages, suggesting common cognitive processes support children's verb learning. (shrink)
